GENERAL TERMS OF SALE
Premises and Acceptance of the General Terms of Sale
These general terms of contract (from now on also referred to as the „General Terms“) regulate the offer by Azienda Agricola Drusian Francesco (from now on also referred to as „Drusian“ or the „Owner“) of products through the sales portal on the website www.drusian.shop (from now on also referred to as the „Site“). The General Terms must be accepted by the User at the moment of the registration on the Site and/or at the time of purchase, in order to benefit from the offers made therein and proceed with the purchase of products.
Drusian reserves the right to modify, in whole or in part, the General Terms at any time, notifying the Users through this website, if the methods of use of the products and services offered change. It is understood that the use of the Site following such modifications constitutes tacit acceptance of the same.

Ownership of the Site

The Site is owned by Azienda Agricola Drusian Francesco, with its headquarters at Via Anche, 1, 31049 Bigolino Di Valdobbiadene (TV), VAT number 01841940263. The name „Drusian“ is a
registered trademark, and all materials, images, texts presented on the Site are the property of the Owner.
Unless otherwise specified on the product/service detail page, it should be understood that the item is sold directly by the Owner. The availability of products/services is subject to quantity/temporal limits. The product offering concerns to service categories (e.g., tastings) and products (wines, grappas, etc.). Following a purchase transaction, the Owner will provide the User with an order confirmation.

Registration on the Site

Note: The Site is exclusively intended for Users who have reached the age of 18.
Navigating and using the services offered on the Site is made accessible through a registration procedure or upon declaration of the user’s legal age.
Registration is free. Users who register on the Site must provide certain personal information and follow all steps in the registration process. At the time of registration, the User will be asked to choose a Username and a Password, which the User agrees not to transfer, even temporarily, to third parties, and to keep with due care, diligence, and confidentiality, under their own responsibility, as these credentials are the only means to identify the User and validate their access to the offers. The User is therefore informed that all actions performed using these credentials will be attributed to them and will have binding effect on them.
The User is required to inform the Owner immediately of any unauthorized or improper use of their login credentials or to report any violations by third parties.
If the Owner detects any violations, they may, at their discretion, block access, permanently delete the information contained within, or refuse to open new accounts for the same User.
At any time, the User may update and/or modify or request the deletion of the information provided during registration. However, in the case of a deletion request, the Owner may temporarily retain, in whole or in part, such information solely for the purpose of executing any purchases made and/or completing accounting and tax procedures.
Registration is required to proceed with summary information related to the activities performed by the User on the site, which otherwise will only be available via email.

Terms of the Offer

The object of the offers on the Site is the purchase of goods/services at the prices indicated on the Site. The Owner reserves the right not to process orders from parties other than the „consumer“ in accordance with their commercial policy. In any case, the Owner does not sell alcoholic beverages to people under the age of 18. By submitting orders, the consumer guarantees that both the ordering party and, if different, the recipient of the goods, are over 18 years of old.

Prices and Shipping Costs

The prices are expressed in Euro and are inclusive of VAT. Shipping costs for goods may be either fixed or variable, calculated based on the weight, the number of selected items, and/or the destination address of the goods. Shipping costs may also be included in the sale price of certain items or be free if the total order amount exceeds a specific value or due to a particular promotion.
The User will always be informed of the shipping costs before completing the purchase process and making payment.
The images accompanying the product or offer information sheets may not be perfectly representative of their characteristics and may differ in color, size, and accessory products shown. All support information for the purchase is intended as general informational material and is not necessarily indicative of the actual characteristics of a specific offer.
The validity of offers may be subject to quantitative or time limitations. In some cases, the availability of a good/service may end after the purchase: in such cases, the Owner will, if applicable, refund the User. It is also possible that for some product offers (e.g., selections of wines from different variants/years), a specific variant/year may not be guaranteed: in such circumstances, the User acknowledges that they may receive a different variant/year of the product than the one chosen during purchase.
In the case of promotional sales, the full price indicated in the offer („struck-through price“) is the one used to calculate the discount applied by the Owner, and it may match one or more of the Owner’s price lists.

Purchase Procedure and Payment Methods

Upon reviewing the offer conditions, the User can complete the purchase by following the procedure on the Site.
The presentation of products and services on the Site constitutes an invitation to offer.
Before finalizing the offer, a summary will be displayed showing the unit cost of the selected item and the total, in case of purchasing multiple quantities of the same item or different items. The cost of any shipping, delivery, or postal fees may be fixed or variable, calculated based on the weight of the goods, the number of selected items, and/or the destination address provided by the User during the purchase process. Shipping fees may also be included in the sale price of some items or be free if the total order amount exceeds a certain value or as part of a specific promotion. The User will always be informed of the shipping fees before completing the purchase process and making payment.
Once the purchase is complete, the User must proceed with the payment, which will be made to the Owner for the Direct Sale.
Upon successful payment, the User will receive an order receipt email. The Order Receipt does not constitute acceptance of the purchase proposal.
After verifying the data, a separate order confirmation email will be sent containing information about the purchased offer. The email will also refer to these General Terms and Conditions.
The confirmation will include a summary of the delivery and billing address. The goods will be shipped within the times indicated in the order confirmation. Delivery times are also indicated
before completing the purchase process in the cart summary or on the product page. This information is indicative and does not represent a guaranteed date, as delays may occur due to the courier’s delivery schedule or other causes beyond the Owner’s control, such as third-party delays or force majeure events.
Without the confirmation email, the purchase cannot be considered validly completed. In such cases, if the amount for the unfulfilled purchase is mistakenly charged to the User, they must promptly notify the Owner by sending an email to shoponline@drusian.it, to allow the Owner to verify the issue and, if necessary, refund the amount paid within 30 working days (excluding Saturdays, Sundays, holidays, and scheduled closures of the Owner).
The accepted payment methods, unless otherwise specified on the site, are: credit cards and prepaid cards from the Visa and Mastercard networks.
The charge for the amounts due occurs, unless otherwise specified in the terms of the offer, at the time of payment confirmation.
If the User realizes they have provided incorrect and/or incomplete information regarding their personal details or the shipping address of the goods, they must notify the Owner promptly and within the order fulfillment timeframe by sending an email to shoponline@drusian.it. In all cases, the User is solely responsible for any incorrect and/or incomplete personal details or delivery address, with the possibility of losing the paid amount if the goods are delivered to unauthorized persons.

Transaction Security

The Owner adopts tools and systems designed to ensure the security of its Users.
The Owner does not process or store payment data (e.g., credit card numbers), which are processed and/or stored by the respective payment service providers. Payment is actually made through protected and encrypted payment data entry fields. It is specified that the Owner has no decision-making power regarding the acceptance/rejection of the transaction on the card proposed for payment. Therefore, the Owner cannot be held responsible in any way for direct or indirect consequences arising from the User’s use of the payment card to make the payment for purchased products and/or services.
Browsing the Site is protected and encrypted with an SSL security certificate. The authenticity of the certificate and its ownership can also be verified by clicking on the appropriate browser protection section, usually next to the address bar, on the page title, or in the status bar.

Discount Codes

The Owner may issue discount codes that the User can use when purchasing products.
Coupons are issued in the form of an alphanumeric code, and their value (in euros or as a percentage) is determined exclusively and at the sole discretion of the Owner. The code can be entered by the User in the „Discount Code“ field when placing the order. The code entered will automatically reduce the sale price, excluding any shipping fees. Codes may be available to the User for a limited time, after which they will no longer be usable. The code may also be subject to a minimum spending amount, below which its use will not be possible. Unless otherwise specified, the code is personal and linked to the User’s account and may only be used for a single purchase, after which it will be automatically invalidated.
Codes are non-cumulative. The codes cannot be sold, transferred, or assigned to third parties without the express authorization of the Owner. The Owner also reserves the right to cancel any previously issued codes, even before their expiration, without the obligation to justify the reason and without the right to compensation or reimbursement. The Owner may also issue discount codes to Users who invite acquaintances, friends, and family to
view the offers on the Site and register on it. To carry out this procedure, the Site may provide functionalities such as „Recommend to a friend,“ „Send offer email,“ „Share on Socials,“ etc. For each new invitee who makes a purchase within a specified time frame, the Owner may grant the User a discount code of a value determined by the Owner each time, to be used on their account for a future purchase. The Owner reserves the right to delete/cancel codes issued to Users who misuse them, without prior notice and without the right to compensation or reimbursement.

Shipping and Delivery

The Owner accepts orders for delivery only within the Italian territory. The shipment of goods occurs within the maximum time possibly indicated on the product page and/or in the order confirmation (it is specified that, unless otherwise indicated, the delivery times on the product page and/or in the order confirmation should be considered indicative, representing an estimated average delivery time, and in any case, they do not represent a
guaranteed delivery date). The maximum time indicated on the product page and/or in the order confirmation refers to working days, excluding Saturdays, Sundays, national holidays, and scheduled company closures (e.g., August, Christmas holidays). Delivery times may also be indicated before completing the purchase process in the cart summary or on the product page. This information is also indicative and does not represent a
guaranteed date. In any case, the Owner, unless otherwise specified on the product page, commits to delivering the goods within 30 working days (as defined earlier) from the order date. If the goods become unavailable for any reason after receiving the order, a refund of any payment received will be issued without charge to the User within 30 working days (excluding Saturdays, Sundays, holidays, and scheduled company closures). The User
may be informed via email when the product is shipped by the Owner. If available, the courier’s name and tracking code may be communicated to the User, allowing them to track the shipment status.
The Owner does not guarantee that multiple products purchased simultaneously will be delivered in a single shipment. A specific delivery date or time cannot be guaranteed, as this depends on the courier, the destination address, and the party responsible for the delivery. Therefore, the Owner cannot be held responsible for any direct or indirect consequences arising from these delivery times. Delivery is considered completed at
street level, excluding any porterage services.
At the time of delivery by the courier, the User is required to check that the packaging is intact, undamaged, or altered, including the sealing materials or any leakage. Any damage to the packaging and/or product must be immediately reported by the User, who should make a written reservation (and specify the reason for the reservation, e.g., „Punctured
package,“ „Crushed package,“ etc.) on the courier’s delivery document. Once the document is signed, the User can no longer make any claims regarding the condition of the delivered items, except for those noted. Any issues regarding the physical integrity,
conformity, or completeness of the received products must be reported within 3 days from delivery by sending an email to: shoponline@drusian.it.
In case of non-delivery of the goods within the indicated time, the User must notify the Owner, who will verify the shipping status directly with the courier. In the event of a shipping anomaly caused by the Owner (e.g., lost or damaged package during transport),
the Owner may, subject to stock availability, proceed with resending the product, depending on its availability in stock, without additional charges to the User, or refund the entire order within 30 working days (excluding Saturdays, Sundays, holidays, and scheduled company closures) from the event.

Product Conformity Warranty

The Owner, when offering third-party products on its Site, cannot be held responsible for damages to persons resulting from violations by suppliers. In any case, the Owner cannot guarantee the completeness of the information provided by the supplier, nor the perfect correspondence of what is described in the product sheet or offer with the product actually
delivered, nor the legitimacy of the supplier’s use of trademarks and images/texts presented. The User is also aware that the images used in the offers may sometimes be merely indicative of the product and not always accurately represent the delivered product.
Any complaints must be sent via email to the address in the purchase confirmation and also to shoponline@drusian.it.
The Owner will be directly responsible for the conformity of its branded products sold on the Site. In case of non-conforming products, the User will contact the Owner by sending an email to shoponline@drusian.it, and the Owner will verify the reported anomaly. After verification, the Owner will proceed with a replacement or refund by crediting the original payment method or issuing a discount code equal to the amount of the purchased product within 30 working days (excluding Saturdays, Sundays, holidays, and scheduled company closures). In any case, the legal warranty is reserved for consumers or individuals who made a purchase on the Site for purposes unrelated to business, commercial, craft, or professional activities they may carry out.

Right of Withdrawal

It is specified that, even for the consumer User, the right of withdrawal is excluded, pursuant to Article 59 of the Consumer Code, for goods that are at risk of deteriorating or cannot be reintroduced into commerce without endangering the health of consumers.
Regarding the cases of exclusion of withdrawal listed above, the User is informed and agrees that among the products that “risk deteriorating or expiring quickly” and cannot be reintroduced into commerce without endangering health, are food products (including wines, alcoholic beverages, and drinks), as the characteristics and qualities of these types of products are subject to alteration due to improper storage.
Therefore, for hygiene/sanitary reasons and to protect the Customers, the right of withdrawal does not apply to the sale of wines/grappas/analogous products on the Site.
If the right of withdrawal is applicable (i.e., for other products/services), the Owner will proceed to refund the total amount due, including delivery costs, if applicable and limited to the lowest delivery charge among those alternative, within 14 days from the day the Owner has been informed of the decision to withdraw from the contract. The refund will be made using the same payment method used for the initial transaction. If the products have been sent to the Owner using a carrier chosen by the consumer User and at their expense, the Owner may suspend the refund until receipt
of the products or until the consumer demonstrates they have sent the products back, if earlier. The consumer is solely responsible for the decrease in the value of the goods resulting from handling the
product in a way other than necessary to establish the nature, characteristics, and functioning of the product. The product must still be kept, handled, and inspected with normal care and returned
intact, complete in every part, fully functional, with all accessories and instruction sheets, with identifying tags, labels, and seals, if any, still attached to the product and intact and unaltered, as well as perfectly suitable for its intended use and free from signs of wear or dirt.

The product must also be shipped to the Owner with packaging suitable to preserve the product’s integrity and proper storage.
The right of withdrawal applies to the product in its entirety. It cannot therefore be exercised in relation to parts and/or accessories of the product. If the product for which the withdrawal has been exercised has suffered a decrease in value resulting from handling the good in a way other than necessary to establish the nature, characteristics, and functioning of the product, the Owner reserves the right to deduct from the refund amount an amount equal to such decrease in value. The Owner will notify this circumstance and the resulting reduced refund amount, providing, if the refund has already been paid, the bank details for the payment of the amount owed by the user due to the decrease in the product’s value. If the withdrawal has not been exercised in accordance with applicable regulations, it will not result in the termination of the contract and, consequently, will not entitle the user to any refund.

Responsibility of the Owner

The Owner cannot be held responsible for any damage that may arise from using the Site, such as computer viruses, omissions, service interruptions, and software failures, even to the User’s computer equipment, which may prevent or delay the provision of services if they are caused by
external forces, force majeure, and/or third parties not dependent on the Owner’s will, such as, merely by way of example: (i) force majeure events; (ii) events caused by third-party actions, such as interruption or malfunction of telecommunication services and/or electricity lines, or actions or omissions by carriers or shippers.

Industrial and Intellectual Property

Without prejudice to the limitation on the use of third-party suppliers‘ distinctive signs, the Owner owns all rights related to the graphic and conceptual content of the Site, as well as its own distinctive signs displayed on it. The reproduction, even partial, of the content and graphics of the Site, as well as of the distinctive signs displayed, is therefore prohibited.

Privacy

Personal data is collected and processed in order to fulfill the User’s requests. The Owner guarantees that it operates in compliance with data protection laws. The privacy notice is considered an integral part of these General Conditions and can be accessed in the Privacy section of the Site or
via the link: https://drusian.it/privacy.

Upon registration, the User may be asked to consent to the receipt of commercial information, including newsletters. In such cases, the User is free to grant or deny consent. Cookies

For the proper functioning of the Site, the use of Cookies is necessary. Cookies are used to gather information about devices, operating systems, IP addresses, and browsers in use, in order to offer the User a better browsing experience. These are generally statistical data, which do not contain

The Site may contain links, in the form of hyperlinks or banners, to external and third-party websites. The Owner does not exercise any control over these sites and does not assume any responsibility for the accuracy, nature, quality, or completeness of the information contained in
third-party websites. The content of such sites does not represent the products, services, or information of the Owner.

Applicable Law and Jurisdiction

These General Conditions will be governed in every aspect by Italian law.
For any disputes regarding the interpretation, execution, and/or resolution of the contract between the User and the Owner, the Parties agree that the Judge of the place of residence or domicile of the User will have jurisdiction, if the User is to be considered a „consumer“ under applicable law. If the User is a professional, the exclusive jurisdiction will be the Court of Treviso.
It is also specified that in the case of a Consumer User, they may submit a complaint by sending an email to shoponline@drusian.it, with the subject „COMPLAINT“ followed by the order number.
The Owner will process the complaint within 45 working days unless exceptional circumstances justify an extension.
If the complaint cannot resolve the dispute, the Owner will provide information about the
Alternative Dispute Resolution (ADR) organizations for out-of-court dispute resolution, indicating whether they intend to use these organizations to resolve the dispute.
The Owner further informs the User who qualifies as a Consumer that a European platform for the
online resolution of consumer disputes (ODR platform) has been established. The ODR platform can be accessed at: http://ec.europa.eu/consumers/odr. Through the ODR platform, the Consumer
User can view the list of ADR bodies, find the link to each body’s website, and initiate an online dispute resolution procedure.
Consumers residing in a European Union member state other than Italy may also access the European procedure established for small claims disputes under Regulation (EC) No. 861/2007, provided the value of the dispute does not exceed €5,000, excluding interest, fees, and costs.
